The White House is offering sweeping, draconian measures targeting immigrants to Senator James Lankford, the Republican lead negotiator, as it seeks to move forward on its supplemental funding request. In addition to previously reported changes to our asylum system, the latest proposals reportedly include ratcheting up mandatory detention of immigrants and expanding the deeply flawed fast-track deportation system called “expedited removal” nationwide. The proposals would also reportedly include a new “expulsion” authority that would allow mass deportations without due process and bypass immigration laws in many cases.

In response to these reports, Anthony D. Romero, executive director of the American Civil Liberties Union had the following reaction:

“If these same immigration proposals were authored by Donald Trump and Stephen Miller, Democrats would be outraged. Expedited removal basically means fake due process for immigrants. Expanding the detention system and fast-tracking deportations contradicts President Biden’s campaign pledges. These proposals will not offer a real fix to our immigration system.

“The administration’s search for a quick fix at the border is becoming increasingly quixotic. Even if these policies are enacted, we will see surges at the border with increased human suffering – as we haven’t addressed the root causes or systemic failures of our immigration system. We urge Congress and the White House to abandon these proposals and do the hard work to advance sensible, humane, and effective solutions to border management. But if the President’s advisors are looking for ways to suppress turnout and enthusiasm among young progressives and immigrant voters, then this will do the trick.”
