ACLU Comment on Supreme Court Stay Ruling in Remain in Mexico Challenge

WASHINGTON — The Supreme Court has allowed a Trump administration policy that sends asylum seekers to wait in Mexico as their claims are considered to remain in effect while the court decides whether to review the case.

The American Civil Liberties Union, Center for Gender & Refugee Studies, and Southern Poverty Law Center are challenging the policy. Last week, the Ninth Circuit Court of Appeals strongly reaffirmed its conclusion the policy is illegal, but allowed it to continue as the government sought Supreme Court review.

Judy Rabinovitz, special counsel in the ACLU’s Immigrants’ Rights Project, had the following reaction to today’s ruling:

“The Court of Appeals unequivocally declared this policy to be illegal. The Supreme Court should as well. Asylum seekers face grave danger and irreversible harm every day this depraved policy remains in effect.”
