The American Civil Liberties Union and the ACLU of Minnesota filed a lawsuit in Minnesota State Court to challenge the coverage ban on transition-related surgery for transgender people on Medical Assistance and MinnesotaCare, the state’s public insurance programs for low-income residents.

In May 2015, the ACLU filed a federal lawsuit against the Michigan Secretary of State challenging a department policy that makes it impossible for many transgender individuals to correct the gender on their driver’s licenses and state identification documents. The court recognized in its November 2015 decision denying the State's motion to dismiss that plaintiffs have sufficiently alleged a constitutionally-protected privacy interest in avoiding disclosure of their transgender status because such disclosure "poses a real threat to their 'personal security and bodily integrity.

The American Civil Liberties Union and the ACLU of Virginia have filed an administrative complaint with the Department of Justice and Department of Education against Gloucester County Public Schools (GCPS) for adopting a bathroom policy that segregates trans students from using the same restrooms and locker rooms as their peers. The school board adopted the policy by a vote of 6-1 on December 9, 2014, despite warnings from the ACLU that the policy violates federal law prohibiting schools from discriminating based on sex.

The American Civil Liberties Union, the ACLU of Arkansas, and co-counsel John Burnett have filed a lawsuit on behalf of Patricia Dawson against her former employer, H & H Electric, for firing her after she transitioned from male to female on the job.
