Biden v. Texas
What's at Stake
The so-called “Migrant Protection Protocols” were a program under the Trump administration that sent asylum seekers back to Mexico to wait for an asylum hearing. The ACLU sued to stop this illegal program, including filing amicus briefs at every level up to the Supreme Court to defend the termination of this cruel and misguided program.
Summary
The so-called “Migrant Protection Protocols” were a program under the Trump administration that sent asylum seekers back to Mexico to wait for an asylum hearing.
In practice, most of those hearings never happened, and people were forced to wait for months or longer in inhumane conditions and were subjected to kidnapping, rape, and murder on a massive scale.
The ACLU, its clients, and its counsel sued to stop this illegal program. The Biden administration paused and then terminated the program. But Texas and Missouri sued, asking a court to order the administration to restart MPP, which it did.
ACLU and ACLU of Texas have filed amicus briefs at every level up to the Supreme Court to defend the termination of this cruel and misguided program.
